Touch new kobo touch out of the box charge and will not power on

Hey all, I bought a kobo touch for my brother for christmas, and I am trying to get it to power on, and it will not.

This is the second kobo device I have tried this week after a constantly resetting mini was taken back to walmart... Kinda annoyed here that I have another device that is not working.

Was there a bad batch or something? I haven't owned a kobo (my last touch worked great, sold to a friend) for a couple of years...
